1) Scope & Acceptance

These Terms of Service (“Terms”) form a binding agreement between you (“Customer”, “you”) and Timeless and Beautiful LLC d/b/a KidsWoodStore (“Company”, “we”, “us”). By accessing the site, requesting a quote, approving designs, or placing an order, you agree to these Terms. If you do not agree, please do not use our services.

Global Compliance: We serve customers in the USA, EU, UK, Canada, GCC and beyond. Mandatory consumer protections that cannot be waived in your location remain intact; otherwise, these Terms apply as written.

2) Definitions

• Custom / Made-to-Order Product: Any product made to your specifications, personalized, or built to order (our core model).
• Standard / Ready-to-Ship Product: Limited small goods or accessories marked as in stock.
• Approved Specs: The drawings, renders, material/finish selections, measurements, and written confirmations you approve in writing (email or similar).
• Defect: A material, verifiable non-conformity that substantially impairs use, safety, or value compared to Approved Specs.
• Business Days: Monday–Friday, excluding observed holidays at our operating hubs.

3) Use of Services

You must be of legal majority to order, or have guardian consent. Use the site lawfully; do not attempt unauthorized access, scraping, or harmful interference. We may suspend service for violations.

4) Quotes, Orders & Design Approvals

• Offer & Acceptance: Placing an order is an offer. A contract forms when we confirm in writing.
• Approvals Are Binding: Once you approve the Approved Specs, they become the contractual reference for fabrication (subject to normal handcrafted tolerances).
• Changes: Email hello@kidswoodstore.com within 24 hours. Significant changes may require change-order fees, revised pricing, and adjusted timelines.

5) Pricing, Taxes & Payment

• Prices are shown in the site currency and exclude taxes/duties unless stated. Customer pays bank FX/processing fees.
• Payment methods are those displayed at checkout/invoice. You confirm you’re authorized to use the method provided.
• No Unfounded Chargebacks (Custom): Custom purchases follow a Final Sale principle. We keep full documentation (approvals, progress, delivery) and will dispute unfounded chargebacks.

6) Cancellations & Flexible Options

Before Production Starts (Custom)

• Design Fee: Non-refundable once concept work/renders/specs are delivered.
• Cancellation (Seller Discretion): May be allowed with a modest cancellation fee (~5–15%) for scheduling/admin, plus the design fee.

After Production Starts (Custom)

• Cancellation may be considered if incurred costs (materials, labor, subcontracting) are covered, plus the design fee and a cancellation fee (~10–25%).
• We can also explore re-scoping or deferral to avoid cancellation.

Standard / Ready-to-Ship: Limited cancellation/returns per Return & Exchange Policy.

7) Custom Products — Principle of Final Sale

• Handcrafted & Unique: Natural wood variations (grain, tone, micro-knots), minor dimensional tolerances, and finish nuances are expected and not defects.
• Final Sale in Principle: Custom work is not resalable; returns/refunds are not available except for verified Defects, remedied as described below.

8) Shipping & Delivery

• We ship worldwide via our U.S., EU, and GCC network. Estimated ship windows are good-faith forecasts.
• Incoterms: Unless agreed otherwise, international shipments are on DAP (Delivered at Place) or similar. Customer pays import duties/taxes and clearance fees; risk passes when goods are made available at the named destination before unloading.
• Transit Claims: Valuable shipments are typically insured. Inspect before signing and note visible damage on the receipt/BOL. Report transit damage/loss to the carrier and us within 48 hours with photos/video; retain all packaging. Transit remedies are pursued via the carrier/insurer (we assist with documentation).

9) Inspection & Defects

• Inspect promptly. If you believe there is a manufacturing Defect (not transit damage), email us within 7 days with photos/video and your order number.
• Acceptance on Delivery: If no written defect notice is received within 7 days, the product is deemed accepted in good order (subject to handcrafted tolerances).

Remedies for Verified Defects (at our option)

• Repair, replacement part(s), full replacement, or—if not feasible—partial/limited refund.
• If return is required for inspection/repair, we will provide instructions and cover reasonable shipping for confirmed Defects.

10) Limited Warranty

For 30 days from delivery, products materially conform to the Approved Specs and are free from significant defects in materials/workmanship under normal use. Misuse, improper assembly/storage, normal wear, and natural material variation are excluded. Where implied warranties cannot be disclaimed, their duration is limited to the shortest period permitted by law.

11) Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages (e.g., lost profits, business interruption, substitute acquisition). Our aggregate liability is capped at the amount you actually paid for the specific item giving rise to the claim (or USD $100 for claims not tied to a specific item). Nothing herein limits liability where doing so is illegal (e.g., personal injury caused by our negligence, fraud).

12) Returns, Exchanges & Chargebacks

• Custom: Final Sale in principle (see Sections 6–7). We may consider cancellations case-by-case as described.
• Standard: Limited returns with RMA within 14 days (new/unused/original packaging), restocking fees may apply. See Return & Exchange Policy.
• No Unfounded Chargebacks (Custom): We maintain full records (approvals, progress, delivery) and contest improper disputes.

13) Compliance & Fair Dealing

We operate transparently and in good faith under applicable consumer, advertising, data protection, and trade laws in the markets we serve. Mandatory, non-waivable consumer rights in your jurisdiction remain intact.

14) Dispute Resolution

• Talk to Us First: Most issues resolve quickly via hello@kidswoodstore.com.
• Negotiation & Optional Mediation: If unresolved, we’ll engage in good-faith discussions; neutral mediation is optional where available.
• Small Claims Friendly: Eligible matters may proceed in small claims court, where permitted, for efficient resolution.

15) Governing Law, Venue & Class Action Waiver

• Governing Law & Venue: State of Wyoming, USA (without regard to conflict rules). Venue is in competent state or federal courts located in Wyoming, USA.
• Non-Waivable Consumer Rights: Where your local law provides mandatory protections, those rights remain intact.
• Class Action Waiver: Claims are brought in an individual capacity only; no class or representative actions to the maximum extent permitted by law.

16) Miscellaneous

• Entire Agreement: These Terms plus incorporated policies (Privacy, Shipping, Returns) are the entire agreement.
• Updates: We may modify Terms; continued use after effective date constitutes acceptance.
• No Waiver / Severability: Failure to enforce is not a waiver; unlawful terms are narrowed or severed, rest remains enforceable.
• Assignment: You may not assign without our written consent; we may assign in connection with business operations, without reducing your non-waivable protections.
• Force Majeure: We are not liable for delays/failures caused by events beyond reasonable control (e.g., severe weather, strikes, customs, carrier issues, pandemics).
• Language: These Terms are in English; translations are for convenience.
• Electronic Communications: You consent to receive notices electronically at the email you provide.
